General conditions for renting a sailing boat

Alliance Yachts (Siret: 8785026160001387850261600013) acting on its own behalf or on behalf of the owner of the vessel.Rented from the customer identified by the rental form, the pleasure craft identified with the form. Such rental is granted to these general conditions, which the customer accepts and undertakes to respect.

I - BOOKING

The booking becomes final when Alliance Yachts receives the amount of the advance payment from the customer.

A- PAYMENT OF BALANCE

The balance of the rental price must be paid at least 30 days before the date of making the vessel available. In the case of booking less than 30 days before it is made available, the full rental price must be paid when the contract is signed. Failing payment of the advance payment or balance within the time limit or in the absence of all or part of the information required, or in the event of return by the customer more than eight days after the dispatch of the contract, Alliance Yachts reserves the right to consider the registration null and void and not to take it into account.

B- AMENDMENT / CANCELLATION

1- Modification of reservation:

We accept changes to the booking limit on availability on that date, provided that they are notified at least 2 days before the start of the stay. In this case, the changes will be billed EUR 30 plus the application of any price supplements due to the new reserved services.
If we are notified less than 30 days before the start of the stay, we consider this change to be a cancellation.

2- Cancellation:

The date of receipt will determine the date of cancellation.
Termination at least 30 days before the start of the stay: EUR 30 is to be paid for our application.
Termination between 30 and 15 days before the start of the stay: the allowance amounts to 30% of the price of the stay.
Termination between 14 and 8 days before the start of the stay: the allowance amounts to 50% of the price of the stay.
Early or late arrival will not result in any reimbursement.
In the event of bad weather conditions, we will refund your down payment or payment or we will change the date of the lease according to your availability.
3- Replacement faculty:

If, for any reason, Alliance Yachts cannot make available to the customer the vessel originally intended under the special conditions, it must provide the customer with a vessel of the same category or larger. No compensation may then be claimed at the Alliance Yachts from that Chief.

II - THE BOAT

A- BOAT CONDITION

1- Handling:

An inventory of the boat and equipment shall be drawn between Alliance Yachts and the TENANT upon taking possession of the boat.

2- Restitution:

Upon exit, Alliance Yachts will carry out an inventory and inventory of the equipment in the presence of the TENANT if possible, or failing that, to verify the status of the return. The deposit will be reimbursed to the TENANT, if any, less the cost of replacing missing or damaged objects, the cleaning and repairs made necessary for the repair of the premises, as soon as possible and at most within four weeks of the end of the lease, and by mail.
Unless expressly authorized by Alliance Yachts, the voluntary non-return of the boat on the scheduled date shall include the owner to the filing of a criminal complaint for breach of trust.

B- MAINTENANCE / CLEANING

The TENANT shall maintain the boat and clean it normally so as to return it at the end of the rental in the condition, including cleanliness, where it was entrusted to it upon arrival. Otherwise, the cleaning will be charged. Any damage to the vessel, loss or destruction of the movable or non-movable parts of the boat shall, of their own accord, to the responsibility of the TENANT. The TENANT customer of the boat shall be personally liable for all damage, loss or damage to the vessel committed by the persons staying with him or to visit him.

C- USE OF THE BOAT

The hire of the boat shall be granted exclusively for the purpose of coastal or high-shore navigation depending on the category of security weapons. Any other use exposes the TENANT to prosecution. The TENANT is responsible for the proper use of electrical and electronic installations, water and evacuation valves. In the event of damage due to improper use of these installations, the repairs are responsible for the TENANT. The lease agreement is concluded intuitu personae. It is therefore neither deceitable nor transmissible. The TENANT must never leave the boat open while it is not. In the event of theft or deterioration resulting from non-compliance with this requirement, the TENANT will be liable. In the event of a flight, the TENANT must transmit the flight declaration receipt by the authorities to the Alliance Yachts as soon as possible.

D- LOCAL PERTURBATIONS

It is up to the customer to comply with the port rules. Alliance Yachts cannot be held responsible.

E- RESPONSIBILITIES

Alliance Yachts shall not be liable for any loss, theft, accident, damage or other irregularity that may occur in respect of any holidaymaker or property (car, luggage, etc.). The holidaymaker's objects or personal effects are strictly within his own responsibility.

F- DOMESTIC ANIMAL

Unless specifically agreed, domestic animals are not allowed on board.

G- CHARACTERISTICS OF BOATS

Boats are equipped for the number of persons indicated on the dish-dish contract, Boat fare and options are made by Alliance Yachts alone, and may in no case give rise to a dispute or recourse by the customer.

III - RENTAL DURATION

A- CONSTITUTION

This lease is granted for the period specified in the lease exclusively. At the end of this period, the TENANT undertakes to return the boat to an Alliance Yachts staff, on pain of being liable to civil or criminal proceedings.

B- EXTENSION

If the TENANT wishes to keep the vessel beyond the period provided for at the beginning of the contract, it will be for him to contact the LOGY in order to examine whether it is possible to satisfy him.

C- END OF RENTAL

The lease ends with the return of the boat and its keys to an Alliance Yachts staff In no case shall the TENANT return the keys to another person even if he claims to represent Alliance Yachts

D- ANTICIPATE RESILION

Any use of the boat which would prejudice the tenant would authorize the tenant to terminate the contract as of right. In this case, the tenant will retain as a penalty clause all the sums paid by the TENANT.

IV - PRICE

Our rental prices are those of a pleasure craft rental. Our prices are published in euros and applicable from 1 January 2015. The rates of stays broadcast by Alliance Yachts have no contractual value and may be changed without notice. The contract price shall be that fixed by the booking confirmation. The occupation of the vessel is strictly limited to the number of persons indicated on the contract.

Our prices are inclusive of all taxes and include the provision of the vessel charges included (water, electricity, gas). Our tariffs do not include: the use of port equipment, cleaning of the ship, the supply of sheets.

A- ARRIVALS

The boat’s keys are handed over every day of the week from 9 a.m. The site of the boat will be carried out on this occasion between Alliance Yachts and the TENANT.

B- DEPARTURES

For weeks or long-term stays, the keys are to be delivered on the day of departure between 8 a.m. and 10 a.m.

C- CAUTION - INVENTORY

Renting a boat means paying a deposit on the handing over of the keys on the day of arrival:

Material and household bond in relation to the size of the boat:

Up to 10 m. 3000 €
From 10 to 13 m: 8 000 €
From 13 to 16 m: 8 000 €
+ de 16 m : 20.000 €

For all boats, regardless of their size, the household is the responsibility of the customer. The vessel is given to the tenant in an impeccable condition, he must be returned in that condition, under the risk of losing part or all of the deposit. We remind you that you must clean the boat before you leave and before our visit (virgin). In the event that the vessel is not returned to its state of integration, the household will be charged EUR 50/hour. Only Alliance Yachts staff are entitled to determine the time to be charged. The deposit will be returned as soon as possible and within four weeks of the end of the lease by mail, possibly less the cost of replacing the missing or damaged objects, repairs necessary for the repair of the premises and the cleaning costs if the vessel is not returned to its original state of cleanliness.

D- INSURANCES

The client declares that he is insured with a personal risk for civil liability.

E- COMPLAINTS

All claims must be made in writing and sent by registered mail to Alliance Yachts's seat no later than 30 days after the end of the stay.

F- DISPUTES

In the event of a dispute, only the Fréjus court has jurisdiction.
